Свети Архијерејски Синод је, под председништвом Његове Светости Патријарха српског г. Порфирија, у Патријаршији српској у Београду, од 7. до 10. децембра 2021. године, приступио извршењу обавезујућих одлука Светог Архијерејског Сабора Српске Православне Цркве које се односе на новоформиране корпорације у Сједињеним Америчким Државама, Православни богословски факултет Светога Саве у Либертивилу и Црквено-школску општину Светога Саве у Њујорку.

Седницама су, поред чланова Светог Архијерејског Синода, присуствовали и Њихова Преосвештенства епископи новограчаничко-средњезападноамерички г. Лонгин, канадски г. Митрофан, западноамерички г. Максим, источноамерички г. Иринеј и буеносајрески и јужно-централноамерички г. Кирило, као и чланови Комисије Светог Архијерејског Синода за разматрање наведених питања: Њихова Преосвештенства епископи бачки г. Иринеј и шумадијски г. Јован, као и протојереј-ставрофор др Велибор Џомић, протојереј Владан Симић, протонамесник Мирослав Чолаковић, те господа правници Срђан Тодоровић, Мирослав Николић и Милан Андрић.

Свети Архијерејски Сабор је 29. маја 2021. године донео једногласну одлуку којом су „Устав, Општа правила и Уредбе, Једнообразна правила и уредбе за парохије у црквено-школским општинама Српских православних епархија у Сједињеним Америчким Државама“ стављене ван снаге, са обавезом да се новоформиране корпорације и друге новоформиране структуре црквене управе наших епархија на тлу америчког континента врате на стање пре 2017. године, изузев у оним тачкама где то практично није неопходно или могуће. Свети Архијерејски Синод је задужен да, у сарадњи са нашим архијерејима у Новом свету, спроведе ову одлуку.

Свети Архијерејски Синод је, по проучењу обимне документације која се тиче црквено-правног и правног статуса новоформираних корпорација, донео одговарајуће одлуке, а епископима г. Лонгину, г. Максиму и г. Иринеју ставио у дужност да их спроведу по изричитим упутствима и налозима Светог Архијерејског Синода у року од два месеца. Стручни тим Светог Архијерејског Синода је утврдио да у правном систему САД не постоји ниједна правна препрека за спровођење донетих одлука. На тај начин, црквена имовина у САД, која је 2017. године пренета на новоформиране корпорације, биће враћена у редовни црквено-правни статус и представљаће искључиву и неотуђиву имовину Српске Православне Цркве на простору САД. Црквеном имовином у САД ће се убудуће управљати, без индивидуалног права на отуђење или оптерећење било које врсте, искључиво у складу са свештеним канонима Православне Цркве и Уставом Српске Православне Цркве, а под непосредним надзором Светог Архијерејског Синода.

Разматрано је и питање статуса и мисије Православног богословског факултета Светог Саве у Либертивилу као једине високошколске богословске установе Српске Православне Цркве на америчком континенту. Једнодушно је закључено да Богословски факултет треба да настави своју духовну и просветну мисију у складу са Уставом Српске Православне Цркве, односно на исти начин као и остале богословске установе Српске Православне Цркве, а под духовним покровитељством Његове Светости Патријарха српског г. Порфирија. У наредном периоду ће бити размотрени и Светом Архијерејском Синоду поднети на одобрење предлози за унапређење рада на Богословском факултету у Либертивилу.

Свети Архијерејски Сабор је 28. маја 2021. године донео одлуку којом је Његова Светост Патријарх српски г. Порфирије умољен да, у координацији са Светим Архијерејским Синодом, помогне Епископу источноамеричком г. Иринеју „у превазилажењу проблема који су настали у Црквено-школској општини Светог Саве у Њујорку, у циљу васпостављања црквеног поретка и јединства међу тамошњим парохијанима“.

Свети Архијерејски Синод се, ради извршења обавезујуће саборске одлуке, упознао са обимном документацијом и проблемима у Црквено-школској општини у Њујорку, а посебно са питањем обнове њујоршке цркве Светога Саве, која је изгорела у пожару на Васкрс 2016. године. Са жаљењем је примљена вест да, ни после пет година од пожара и новчаних средстава уложених у обнову, храм Светога Саве у Њујорку није оспособљен ни за богослужења на велике празнике. Неопходно је да се, без одлагања, међу њујоршке Србе што пре врате мир, поверење и јединство и да се у братској љубави обнови црква која је посвећена нашем духовном оцу Светоме Сави. Свети Архијерејски Синод ће, придржавајући се одлуке Светог Архијерејског Сабора, благовремено донети одлуку о најцелисходнијем конкретном начину решавања свих ових питања и о томе ће обавестити црквену и укупну јавност.

Призивајући благослов Божји на наше верне духовне синове и кћери у Америци, упућујемо им очинске поздраве са позивом да, као и до сада, ревносно чувају своју православну веру, светиње, српски идентитет и завете предака, а посебно јединство наше Светосавске Цркве.

The Holy Synod of Bishops, under the presidency of His Holiness Serbian Patriarch kyr Porfirije, in the Serbian Patriarchate in Belgrade from 7 do 10 December of this year, began to carry out the binding decisions of the Holy Assembly of Bishops of the Serbian Orthodox Church concerning the newly-formed corporations in the United States of America, the Saint Sava School of Theology in Libertyville, and the Church-School Congregation of Saint Sava in New York.

Alongside the members of the Holy Synod of Bishops, the meetings were also attended by Their Graces the Bishops of New-Gračanica and Midwestern America kyr Longin, Canada kyr Mitrofan, Western America kyr Maksim, Eastern America kyr Irinej and Buenos Aires and South-Central America kyr Kirilo, as well as the members of the Commission of the Holy Synod of Bishops for considering the above-mentioned matters: Their Graces Bishops of Bačka kyr Irinej and Šumadija kyr Jovan, as well as protopresbyter-stavrophoros Dr Velibor DŽomić, protopresbyter Vladan Simić, protonamesnik Miroslav Čolaković, and legal counselors Srđan Todorović, Miroslav Nikolić and Milan Andrić.

The Holy Assembly of Bishops rendered a unanimous decision on 29 May 2021, by which the “Constitution, General Rules and Regulations, Uniform Rules and Regulations of Parishes and Church-School Congregations of the Serbian Orthodox Dioceses in the United States of America” were annulled, with the obligation that the newly-formed corporations and other newly-formed structures of the ecclesial administration of our Dioceses on the North American continent be returned to pre-2017 status, except in those cases where it is not practically necessary or feasible. The Holy Synod of Bishops was tasked with carrying out this decision, in cooperation with our Hierarchs in the New World.

The Holy Synod of Bishop, after thoroughly studying the extensive documentation concerning the ecclesial-legal and the legal status of the newly-formed corporations, rendered the appropriate decisions, while charging Bishops kyr Longin, kyr Maksim and kyr Irinej with implementing them within two months, in accordance with the explicit instructions and injunctions of the Holy Synod of Bishops. The expert team of the Holy Synod of Bishops determined that not one legal obstacle exists within the legal system of the USA for the implementation of the decisions rendered. In this manner, church property in the USA, transferred to the newly-formed corporations in 2017, will be returned to normal ecclesial-legal status, and will represent the exclusive and inalienable property of the Serbian Orthodox Church on the territory of the USA. In the future, church property in the USA will be administered without the right of an individual to alienate or mortgage it in any form, exclusively in accord with the Sacred Canons of the Orthodox Church and the Constitution of the Serbian Orthodox Church, and under the immediate supervision of the Holy Synod of Bishops.

The question of the status and mission of the Saint Sava Orthodox School of Theology, as the only theological school of higher learning of the Serbian Orthodox Church on the North American continent, was also considered. It was unanimously concluded that the Theological School should continue its spiritual and educational mission in accord with the Constitution of the Serbian Orthodox Church, i.e. in the same manner as other theological institutions of the Serbian Orthodox Church, and under the spiritual auspices of His Holiness Serbian Patriarch kyr Porfirije. In the upcoming period, suggestions for the advancement of the work of the Theological School in Libertyville will be considered and submitted to the Holy Synod of Bishops for approval.

On 28 May 2021 the Holy Assembly of Bishops rendered a decision by which His Holiness Serbian Patriarch kyr Porfirije was requested to assist the Bishop of Eastern America kyr Irinej, in coordination with the Holy Synod of Bishops, “in overcoming the problems that have arisen in the Church-School Congregation of Saint Sava in New York, with the aim of re-establishing ecclesial order and unity among the parishioners there.”

The Holy Synod of Bishops, in order to carry out the Assembly’s binding decision, familiarized itself with the extensive documentation and problems within the Church-School Congregation in New York, especially with the question of the restoration of the church of Saint Sava in New York, which burnt down in a fire on Pascha in 2016. With sadness the news was acknowledged that, even five years after the fire and the monetary aid invested in the restoration, the church of Saint Sava in New York has not been put into function even for divine services on Great Feastdays. It is essential that, without delay, peace, trust and unity be restored among the Serbians of New York as soon as possible, and that the church dedicated to our spiritual Father Saint Sava be restored in fraternal love. The Holy Synod of Bishops will in good time, adhering to the decision of the Holy Assembly of Bishops, render a decision concerning the most expedient concrete way of resolving all these issues, about which it will inform the church and public in general.

Calling the blessing of God upon our faithful spiritual sons and daughters in America, we address paternal greetings to them, with the call to fervently guard, as they have till now, their Orthodox Faith, places of worship, Serbian identity and vows of their forbearers, and especially the unity of our Church of Saint Sava.
